In-Canada Asylum Claims

Protection for people within Canada who are at risk in their home country

Safety and a Fresh Start in Canada

If you cannot return to your home country because of danger or persecution, Canada may offer you protection. An asylum claim lets you ask Canada to keep you safe when going back home would put your life at risk.

Successful claimants become protected persons under Canadian law. This means you can stay in Canada safely, work to support yourself, and eventually apply for permanent residency. Your children can go to school. Your family can build a stable future together, free from the threats you faced before.

Canada's refugee protection system is built on fairness and compassion. Every year, thousands of people find safety here after fleeing violence, political persecution, or other serious dangers.

Ready to Get Started?

Asylum deadlines are short, and one inconsistency in your forms or testimony can undermine your whole case. We help you present clear, credible evidence, on time, that shows the IRB why you need protection.

Who Can Make an Asylum Claim

You may be able to claim refugee protection in Canada if you face serious risk in your home country. The grounds for protection include:

  • Fear of persecution based on your race, religion, nationality, political beliefs, or membership in a particular social group
  • Danger of torture if you return home
  • Risk to your life from violence or conflict
  • Risk of cruel or unusual treatment that your government cannot or will not stop

You can make your claim at a Canadian airport, seaport, or land border when you arrive. If you are already in Canada, you submit your claim online through the IRCC Portal and then attend an in-person appointment with IRCC. There is no application fee for refugee claims.

Starting November 3, 2026, IRCC is changing the asylum application in the IRCC Portal. If you submit your claim before 11:59 p.m. Eastern Time on November 2, 2026, you will not need to provide new information unless IRCC asks for it. If you started your claim but did not submit it by then, you will have to answer new questions and review your earlier answers; your personal information is saved.

How the Asylum Process Works

After you make your claim, a CBSA or IRCC officer will check if you are eligible. If eligible, your claim goes to the Immigration and Refugee Board (IRB) for a hearing. You will receive a Refugee Protection Identity Document that confirms your claim status.

Once your claim is referred to the IRB, you may qualify for an open work permit at no extra cost. This lets you support yourself while you wait for your hearing. Minor children can attend school without a study permit - they just need their identity document.

At your hearing, an IRB member will review your evidence and listen to your story. You must show why you cannot safely return home. After hearing your case, the Board will decide whether to grant you protection.

If approved, you become a protected person and can apply for permanent residency. If refused, you may appeal to the Refugee Appeal Division within 15 days, or seek judicial review at Federal Court.

Challenges You May Face

The asylum process has strict rules and tight deadlines. If you make your claim at a port of entry, you have 45 calendar days after your claim is sent to the Refugee Protection Division to submit your Basis of Claim (BOC) form. If you make your claim from inside Canada, the BOC form is part of the online application, which you must complete within 90 days of starting it in the IRCC Portal; after that you will have an in-person appointment with IRCC. Missing these deadlines can hurt your case badly.

The Safe Third Country Agreement between Canada and the United States affects claims made at land border crossings. Since March 2023, this agreement applies to the entire Canada-US land border, not just official crossing points. There are limited exceptions for people with family in Canada, unaccompanied minors, and some other situations.

Certain factors can make you ineligible for an asylum claim altogether. These include having refugee status in another safe country, serious criminal history, security concerns, or having a previous refugee claim rejected, abandoned, or withdrawn in Canada. Withdrawing a claim is final: if you withdraw it, you will not be able to claim asylum in Canada in the future.

Building a strong case requires more than telling your story. You need credible evidence, consistent testimony, and documents that prove the danger you face. Country condition reports, news articles, police records, and medical evidence can all support your claim. But gathering and organizing this evidence takes skill and experience.

Why Professional Help Matters

Your asylum claim affects your safety and your future. One mistake in your paperwork or testimony could mean being sent back to danger. The process involves multiple government forms, strict formatting rules, and evidence requirements that change based on your situation.

Immigration officers review thousands of applications. They look for inconsistencies, missing information, and weak evidence. They know how to spot claims that lack credibility. Your case needs to anticipate their questions and address their concerns before they arise.

We understand what the IRB expects to see. We help you organize your evidence, prepare your testimony, and present your case as clearly and convincingly as possible. Every detail matters when your safety is on the line.

Start Your Claim With Confidence

Your journey to safety in Canada does not have to feel overwhelming. With the right guidance, you can navigate the asylum process knowing your case is being handled properly.

Book a consultation to discuss your situation and learn how we can help protect your future.
